Wyne's General Terms & Conditions cover a wide range of topics, including acceptable use, user conduct, account security, privacy, and intellectual property. Please review these terms to ensure a compliant and positive experience on Wyne.

1. Acceptance of Terms

By accessing or using the wyne app ("App"), you agree to comply with our Terms & Conditions. If you disagree with any part of the terms, you may not access Wyne. Please read this overview to understand the key points of our Terms and Conditions.

2. Registration and Account Security


2.1. Account Creation: To access certain features of the App, you must create a user account. You are responsible for providing accurate and up-to-date information during the registration process.

2.2. Account Security: You are responsible for maintaining the security of your account credentials and any activities that occur under your account. Notify us immediately if you suspect unauthorized access to your account.

3. User Content

You own your content that you post on the App. However, by posting or sharing content on Wyne, you grant us a non-exclusive, worldwide, royalty-free, and sublicensable license to use, reproduce, modify, adapt, publish, and distribute the content.

4. Copyright and Intellectual Property

4.1 Ownership

a. All content, materials, and intellectual property on the Wyne platform, including but not limited to text, graphics, images, logos, trademarks, software, and audiovisual elements, are the exclusive property of Wyne or its content providers.

b. You agree not to reproduce, modify, distribute, display, or create derivative works of any copyrighted or trademarked content without prior written permission from Wyne.

4.2. User-Generated Content

a. By posting or sharing user-generated content on Wyne, you grant Wyne a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, and display your content for the purpose of providing and promoting the platform's services.

b. You retain ownership of your user-generated content, and this license does not transfer any intellectual property rights to Wyne.

4.3. Music Copyright

a. Permission to Use Music/Audio: Users must ensure they have the necessary rights or permissions to use any music or audio content uploaded or shared on the Wyne platform. This includes obtaining licenses or permissions from copyright holders, such as artists, record labels, and publishers.

b. Verification of Rights: Before uploading or sharing any music or audio content, users are required to verify that the material is free from copyright restrictions or that they have obtained the appropriate licenses for use. This applies to all forms of music and audio, including background tracks, sound effects, and any other audio content.

c. Compliance with Copyright Laws: Users must comply with all applicable copyright laws and regulations. Unauthorized use of copyrighted music or audio is strictly prohibited and may result in legal action from the copyright holder.

4.4. Accountability for Violations

a. User Liability: Users are solely responsible for any copyright violations resulting from the use of unauthorized content on the Wyne platform. Wyne does not assume any liability for user-generated content that infringes on copyright laws.

b. Content Removal: Wyne reserves the right to remove any content or audio that it believes, in its sole discretion, may infringe upon the rights of third parties. Repeated violations of this policy may result in account suspension or termination.

c. Reporting Infringements: If you believe that your copyrighted work has been used without permission on the Wyne platform, please contact us immediately with detailed information regarding the alleged infringement. Wyne will take appropriate action in accordance with applicable copyright laws.

4.5. Copyright Infringement

a. Wyne respects the intellectual property rights of others and expects its users to do the same. If you believe that your copyrighted work has been used on the platform without authorization, please notify us with the following information:​

 

  • A description of the copyrighted work in question.

  • Identification of the allegedly infringing content and its location on Wyne.

  • Your contact information, including name, address, email, and phone number.

  • A statement that you have a good-faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.

  • A statement, made under penalty of perjury, that the information provided is accurate, and you are the copyright owner or authorized to act on behalf of the owner.

4.6. Trademarks

a. The trademarks, logos, and service marks displayed on Wyne are registered and unregistered trademarks of Wyne and its affiliates.

b. You are prohibited from using any trademarks, logos, or service marks without prior written permission from Wyne.

4.7. Digital Millennium Copyright Act (DMCA)

a. Wyne complies with the provisions of the Digital Millennium Copyright Act (DMCA) and promptly responds to valid DMCA takedown notices.

b. If you believe that any content on Wyne infringes your copyright, you may submit a DMCA takedown notice following the guidelines provided by the U.S. Copyright Office.

4.8. Intellectual Property Complaints

a. For any intellectual property complaints or inquiries, please contact support@wyne.shop.

By using Wyne, you agree to respect and uphold the intellectual property rights of others and comply with all applicable copyright laws and regulations.

5. Termination

5.1. You may terminate this Agreement by discontinuing the use of the App and closing your account. Wyne reserves the right to terminate this Agreement and your access to the App at any time and for any reason, with or without notice.

 

5.2. Termination may occur if a user violates the terms of service or posts content related to the following: sexual content, harassment and bullying, threats, violence and harm, harmful false or deceptive information, illegal or regulated activities, hateful content, terrorism, violent extremism, or impersonating or harassing moderators or the Wyne team.

6. Third-Party Integrations

6.1. Wyne may integrate with third-party services, applications, or platforms to enhance user experience and provide additional functionalities.

6.2. Users acknowledge that these third-party integrations may require access to certain personal information or data. Wyne shall seek user consent before granting such access and will comply with applicable data privacy laws.
 
6.3. While Wyne strives to maintain secure integrations with trusted partners, it does not assume responsibility for the actions, policies, or practices of third-party services.

6.4. Users are encouraged to review the terms of service and privacy policies of third-party integrations before granting access to their data.

6.5. Wyne reserves the right to modify, add, or remove third-party integrations at any time without prior notice.

6.6. Users should report any concerns or issues related to third-party integrations to Wyne's support team for prompt resolution.

By continuing to use the Wyne platform and its integrated third-party services, users consent to the terms outlined in this Third-Party Integrations policy.

7. External Links

7.1. Wyne may contain links to external websites or resources that are not owned or controlled by us. While we strive to provide reliable and relevant content, we are not responsible for the content, privacy policies, or practices of any third-party websites. The inclusion of external links on our platform does not imply endorsement, affiliation, or sponsorship by Wyne.

7.2. Users are advised to exercise caution and review the privacy policies and terms of use of any external websites they visit. Wyne disclaims all liability for any damages or losses arising from the use of external websites or resources accessed through our platform.

7.3. We encourage users to report any inappropriate or broken external links found on our platform by contacting our support team at support@wyne.shop.

8. Payment Terms

8.1. Payment Methods

 

Wyne accepts payments through various secure payment methods, including Apple Pay, credit cards, debit cards, and other payment gateways. By using these payment methods, you agree to comply with respective terms and conditions.

8.2. Billing Information

 

You are responsible for providing accurate and up-to-date billing information. Should any changes occur in your payment details, you must update your account promptly to avoid issues with processing your orders.

8.3. Fee Changes

 

Wyne and our brands reserves the right to modify product prices at any time. In the event of a price change, the new price will apply to future purchases and will not affect any orders already placed.

9. Refund and Cancellation

Wyne is committed to ensuring your satisfaction with every purchase made through our platform. We understand that circumstances may arise where you need to request a refund or cancel your order. Please carefully review our policy to understand how to proceed in such situations.

9.1. Order Cancellation and Refunds


You may cancel your order within the cancellation window specified on the product page. Once an order is confirmed by the brand, cancellation is no longer possible. Refund eligibility varies based on product type and the reason for cancellation. Items such as discounted products or beauty items may not be eligible for return. For specific details, please refer to the product information.

Refunds will be credited to your Wyne account in the form of Wyne Credits. Each credit is equivalent to USD 1 (i.e., $1 credit = $1). Users can later cash out these credits by initiating the process through their Wyne balance. Upon your request, the balance will be transferred back to your original payment method. Please note that while the credits are automatically applied to your account, users must manually request the cash-out. The cash-out process is an instant transfer once initiated.

9.2. Failed Payments


In the event of a failed payment, we will notify you and make another attempt to process the payment. If the payment remains unsuccessful, your order may be canceled. Instructions will be provided on how to update your payment details to complete the purchase.

9.3. Currency and Taxes


All prices and fees are displayed in USD and include applicable taxes unless otherwise stated. You are responsible for any additional taxes or charges imposed by your local authorities.

9.4. Disputes and Chargebacks

For billing errors or disputes, contact us directly through the Wyne app using the support feature or via email at support@wyne.shop. We will investigate the issue and correct any errors as necessary. Please note that filing unauthorized chargebacks may result in account suspension or termination.

10. Communication

10.1. By creating an account on Wyne, you agree to receive transactional emails and communications related to your account and purchases.

10.2. You may also receive promotional offers and marketing communications from Wyne, which you can opt-out of at any time.

11. Disclaimers and Limitations of Liability

11.1. Use of Wyne Platform

a. Wyne provides its platform and services on an "as-is" and "as available" basis. Users access and use the platform at their own risk and discretion.

b. Wyne does not warrant that the platform will be error-free, uninterrupted, or free of viruses or other harmful components. Users are responsible for implementing suitable measures to protect their devices and data.

11.2. Content Accuracy

a. Wyne makes reasonable efforts to ensure the accuracy and reliability of the content available on the platform. However, it does not guarantee the accuracy, completeness, or reliability of any information, product descriptions, or user-generated content.

b. Users are advised to exercise their own judgment when relying on information obtained from Wyne and should verify critical information independently.

11.3. Third-Party Links and Content

a. The Wyne platform may contain links to third-party websites or services. Wyne does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party websites or services.

b. Users acknowledge and agree that Wyne shall not be liable for any damages or losses arising from the use of third-party links or services.

11.4. Product Representation

a. Wyne strives to present products accurately and provide reliable information about them. However, product colors, sizes, and specifications displayed on the platform may vary slightly from the actual products.

b. Users should refer to the original product descriptions and specifications provided by the respective sellers for precise information.

11.5. User Conduct

a. Users are solely responsible for their actions and interactions on the Wyne platform.

b. Wyne reserves the right to suspend or terminate the accounts of users who violate the platform's terms of service or engage in any behavior deemed inappropriate or harmful.

11.6. Limitation of Liability

a. To the extent permitted by law, Wyne shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages, including but not limited to loss of profits, data, or goodwill, arising from the use or inability to use the platform or services.

b. Wyne's total liability, whether in contract, warranty, tort (including negligence), or otherwise, shall not exceed the amount paid by the user, if any, for using the platform or services during the twelve months preceding the claim.

11.7. Indemnification

a. Users agree to indemnify and hold Wyne, its officers, directors, employees, and agents harmless from any claims, demands, losses, liabilities, or expenses, including legal fees, arising from their use of the platform or violation of these terms.

11.8. Changes to Terms

a. Wyne reserves the right to modify or update these disclaimers and limitations of liability at any time without prior notice.

b. Users will be notified of any material changes through the Wyne platform or official communications.

By accessing and using the Wyne platform, users acknowledge and accept these disclaimers and limitations of liability. If users do not agree with these terms, they should discontinue using the platform.

12. Accessibility and Well-Being Statement

12.1. At Wyne, we prioritize user well-being and want to remind users to use the app responsibly. Wyne is not responsible for any stress, anxiety, or health issues that may arise from extended app usage or interactions on the platform. We recommend taking regular breaks and maintaining balance when engaging with the app and social interactions.

12.2. We are committed to creating a user-friendly and inclusive experience for everyone. While we are actively working on implementing accessibility features in the app, we encourage users to share feedback on any barriers they encounter. 13. Governing Law

These Terms & Conditions, and any disputes arising out of or relating to them, shall be governed by and construed in accordance with the laws of the State of [Your State], United States, without regard to its conflict of law principles. By using Wyne, you agree to submit to the exclusive jurisdiction of the state and federal courts located in [Your State] for the resolution of any disputes.

14. United States Legal Compliance

By using our App, you agree to comply with all applicable local, state, and federal laws and regulations of the United States. This includes, but is not limited to, export control laws and regulations. You represent and warrant that:

a. You are not located in a country that is subject to a U.S. government embargo or that has been designated by the U.S. government as a "terrorist supporting" country.

b. You are not listed on any U.S. government list of prohibited or restricted parties.

Wyne reserves the right to limit the availability of our services to any person, geographic area, or jurisdiction at any time and in our sole discretion.

15. California Proposition 65

15.1. Proposition 65 requires the provision of a warning to California consumers regarding products containing certain chemicals. We are providing the Proposition 65 warning for the products that are depicted or offered for sale on or through our App: WARNING: This product contains chemicals known to the State of California to cause cancer and birth defects or other reproductive harm.


15.2. While we make every effort to feature products responsibly, we also want our customers to make informed purchasing decisions, including learning more about Proposition 65. For more information about Proposition 65, please visit the California OEHHA Proposition 65 program at www.oehha.ca.gov.

16. Severability

If any provision of these Terms & Conditions is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

17. Waiver

Except as expressly provided herein, the failure to exercise any right or to require the performance of any obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter. Additionally, a waiver of any breach shall not constitute a waiver of any subsequent breach.

18. Changes to Terms

We reserve the right to modify or update these Terms & Conditions at any time. Changes and clarifications will take effect immediately upon their posting on the App. If we make material changes to this policy, we will notify you through the App that it has been updated.
